Once the Administrative
Law Judge has either reviewed the case or listened to your arguments,
they will make a decision concerning your Social Security disability
denial. Although in some instances a judge may announce their decision
immediately, don't expect the judge to notify you of their decision
right away. You may have to wait again, but the good news is that you
should hear something much sooner than the previous waiting periods,
although it may still be several weeks.

The Verdict is In. Maybe...An Administrative Law Judge has several options when deciding a Social Security disability denial case. First, they have the option to tell the Social Security Administration to start providing your benefits. This, of course is the best of all decisions. On the other hand, the judge may also agree with the government and deny your right to disability benefits. The judge may also return the case to the SSA with instructions to review it further. Unfortunately this situation means more time and maybe even more effort on your part to try to overturn the disability denial. The SSA will follow the judges order and carefully review your denial once more and see if they can instate your benefits. If, after this review, the SSA decides once more that you do not qualify for Social Security disability benefits then you may again appeal their denial. If an Administrative Law Judge denies your benefits and if you have hired a Social Security disability lawyer, they may file a petition in a Federal Appeals court requesting a review of your case. Only a lawyer can represent you before the Federal Court. A Social Security advocate or representative can no longer assist you at this point. In rare instances, Social Security disability denial cases have even been taken all the way to the United States Supreme Court. Federal appeals judges have the same options as an Administrative Law Judge in their decisions. They may approve or deny your benefits, or they may send the case back to the Administration for further consideration.
